    Understanding Oklahoma's Electronic Visit Verification

    The date when the CMS approved Oklahoma for EVV Good Faith Extension Request Approval. While the final implementation deadline was yet to be determined, home care agencies had to be prepared well ahead of time to escape claim denials and penalties.

    January 1, 2024

    PCS needed full EVV compliance by Jan 1, 2020; HHCS had a later deadline of Jan 1, 2023. Oklahoma received a Good Faith Effort (GFE) exemption for HHCS, approved Dec 14, 2022. By Jan 1, 2024, CMS officially recognized Oklahoma as fully EVV-compliant for both PCS & HHCS.

    Oklahoma’s Home Services Division, part of the State Department of Health, licenses and regulates home care, companion sitter, and hospice agencies. Its staff conduct on-site surveys, investigate complaints, make home visits to clients, and enforce compliance with minimum standards outlined in Oklahoma Statutes Title 63 and the Oklahoma Administrative Code Title 310.

    The state has enacted rules to protect seniors aging in place. Notable protections include:

    • The No Surprises Act is a federal law in effect since January 1, 2022, protecting individuals under group and individual health plans from surprise medical bills—specifically for emergency care and non-emergency out-of-network services at in-network facilities.
    • Vacation (PTO) in Oklahoma is not required by law—paid or unpaid. Employers may offer it, but must follow their own written policies if they do. The employer also determines whether unused vacation must be paid out at separation.
    • Overtime pay: Oklahoma does not have its own state overtime laws. Instead, home care agencies must comply with the federal Fair Labor Standards Act (FLSA)—meaning non-exempt workers must receive at least 1.5× their regular rate for hours worked beyond 40 in a workweek.
    • Caregiver training in Oklahoma is mandatory. The Professional Association of Caregivers recommends an 8-hour Certification Course for in-home caregivers.

    This means home care agencies must use an electronic system—such as GPS apps or IVR—to confirm Medicaid-funded personal care and home health visits. It ensures accurate tracking of who, when, where, and what service was delivered, cuts fraud, prevents claim denials, and protects Medicaid reimbursement.

    Oklahoma law requires non-exempt employees be paid at least twice per calendar month on regular, pre-designated paydays. Paychecks must include itemized deductions. Employers may schedule payday up to 11 days after the pay period ends, with a 3-day grace allowance.

    Oklahoma follows the at-will employment doctrine—meaning either party can terminate the employment relationship at any time, for any or no reason. However, employers cannot act unlawfully: termination may still be challenged if based on discrimination, retaliation, violation of public policy, breach of implied or explicit employment contracts.
